In the United States, the permanent resident card, often called “Green Card,” is given to persons who have been granted permanent resident status in the country. There are several ways to get a Green Card, but the most common way is through sponsorship by a family member or employer.
US citizens and permanent residents can be sponsors for family members seeking Green Cards. US citizens can sponsor spouses, children, parents, and siblings; Green Card holders can sponsor spouses and children as they seek their own Green Card in the USA.
Immediate Relatives of US citizens have visa numbers available immediately; spouses, unmarried children under the age of 21, and parents are among these relatives. Relatives of US citizens who do not have visa numbers immediately available include unmarried children over the age of 21, married children of any age, and siblings (when the US citizen sponsor is above the age of 21); these relatives fall under the “family preference category. For them, a visa number will not be available until their priority date (the date on which the US citizen sponsor correctly filed the application with the USCIS) becomes current. A waiting period is involved because the number of visas in the preference categories is fixed by Congress.
A sibling of a US citizen falls under the fourth preference category. The US citizen petitioner will first have to file Form I-130 with the USCIS to establish the relationship with
the beneficiary. Once the filing is approved, the wait for the priority date to become current begins. When the visa number becomes available, the sibling will have to apply either for an adjustment of status to permanent resident or for an immigration visa, depending on whether or not he or she currently resides inside the US. Once the application is approved, the petitioning relative will be issued a Green Card for the purpose of permanently living/working in the US.
